EDGITAL GmbH takes the protection of your personal data seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection information. In the first part of this data protection information, you will find information about the processing of your personal data in connection with your visit to the www.edgital.io website as well as a summary of your rights under the European General Data Protection Regulation (hereinafter "GDPR"). Personal data is any data by which you can be identified or be identifiable. In the second part you will receive information about the cookies we use.

Part 1

3. Data processing when visiting the website

a) Processed personal data

During (purely informational) visits to our website, we collect so-called log data (hereinafter "log data"). This log data is collected by our IT systems, either automatically or following your consent, when you visit the website. It is a data record (also called server log files) that is only temporarily stored. The data record contains the following data of the use of the website:

  • IP addresses,

  • Preferences, websites you visited before visiting our website,

  • Information about your browser, your network or device (type, browser version, operating system, internet provider, settings, unique device IDs and language, and other regional settings).

Insofar as you consent to the use of analytics and performance cookies when visiting our website (cf. Part 2 of this data protection information), the following data from the use of the website will also be processed (hereinafter “visit data”):

  • Information about your interaction with our website (such as time stamp, clicks, scrolling time, visit duration, searches, referring websites, load times, and problems you may encounter, such as loading errors).

When you use the contact form, we collect the data you provide. This includes the following data (hereinafter “contact form data”):

  • Contact information (first name, last name, e-mail address and comment) as mandatory information. The indication of your telephone number is voluntary.

b) Purpose and legal grounds of processing

  • Log data

The log data is processed for statistical purposes as well as to improve the quality of our website, in particular the stability and security of the connection and the error-free provision of the content, and thus serves our legitimate interest (Art. 6 para. 1 p. 1 lit. f GDPR).

  • Visit data

The processing of visit data is carried out for statistical purposes as well as to improve the quality of our website, in particular the stability and security of the connection and the analysis of your user behavior, based on your consent (Art. 6 para. 1 p. 1 lit. a GDPR).

  • Contact form data

The processing and storage of contact form data is solely for the purpose of responding to your request or for contacting you. The legal basis for the processing of this data is your consent in accordance with Art. 6 para. 1 p.1 lit. A GDPR.

c) Duration of storage

Unless a more specific retention period is specified in this data protection information, all personal data will be deleted as soon as its processing is no longer necessary for the purpose for which it was collected. Insofar as statutory retention obligations apply, the data will be deleted after expiry of the respective retention period. Otherwise, the following deletion periods apply:

  • Visit data: 30 minutes or 2 years (cf. the references on https://support.squarespace.com/hc/de/articles/360001264507#csrf)

  • Contact details: Your data will be deleted after the final processing of your request. This is the case if it can be concluded from the circumstances that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

 d) Recipient of the data

Data will only be passed on if necessary and in the cases listed below. Recipients of the data are:

  • Log Data and Visit Data: Your log and visit data is collected and processed by our third party service provider Squarespace Ireland Ltd, Le Pole Housse, Ship Street Great, Dublin 8, Ireland (hereinafter "Squarespace") on our behalf to learn more about traffic and activity on our website.

  • Contact form data: We share this information for storage and processing purposes with HOCHTIEF PPP Solutions GmbH, whose expertise and resources we rely on to implement our projects.

  • All data: Your data will be passed on to public or supervisory authorities (e.g. competent data protection supervisory authority, public prosecutor's office, etc.) insofar as we are subject to a legal obligation to pass it on. Otherwise, data will only be forwarded to other recipients if you have given us your express prior consent.

  • The services for hosting and displaying the website are partly provided by the service provider Squarespace as part of processing on our behalf.
     

4. Hosting by Squarespace 

Squarespace is a tool for creating and hosting websites. When you visit our website, your data is processed on Squarespace's servers. This may also involve the transfer of personal data to Squarespace's parent company, Squarespace Inc, 8 Clarkson St, New York, NY 10014, USA.

We have concluded a contract on order processing with Squarespace. This ensures that the personal data of visitors of our website are only processed according to our instructions and in compliance with the GDPR.

5. Transfer to third countries

Among other things, we use tools from companies with headquarters - or parent companies’ headquarters - in the USA or other third countries that are not secure under EU data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that in these countries it may not be possible to guarantee a level of data protection comparable to that in the EU.

In particular with regard to the USA, no adequacy decision has been adopted by the European Commission. In case of onward transfer of data to the USA, Squarespace provides for the conclusion of standard contractual clauses within the framework of the Commission Implementing Decision (EU) 2021/914 of 4 June 2021 for the transfer of personal data to third countries in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (cf. https://support.squarespace.com/hc/de/articles/360000851908). 6. Your rights

You have the following rights under the GDPR with respect to the processing of your personal data by us:

  • Right to information about the origin, recipient and purpose of your stored personal data

  • Right to rectification

  • Right to erasure (“right to be forgotten”)

  • Right to restriction of processing

  • Right to data portability

  • Right to object to processing

  • Right to withdraw your consent at any time with effect for the future

To exercise your aforementioned rights, you can contact us at any time using the contact details above. In addition, you may at any time complain to a supervisory authority about our processing of your personal data.

For security reasons and to protect the transmission of confidential content, such as requests that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser bar. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

7. Consent Management Tool

For the purpose of consent management, we use a consent management tool (CMT). The provider of the CMT is Papoo Software & Media GmbH, Auguststr. 4, 53229 Bonn, Germany. When you access our website, a CMT cookie is set, which is used to store the consent given for the individual services and to control the corresponding activation or deactivation of the respective functionalities.

The CMT is used to obtain the necessary permissions and to document them in accordance with our obligation to provide evidence. The legal basis for this is Art. 6 para. 1 lit. c GDPR.

The CMT is provided by a service provider who processes the data on our behalf. The collected data is stored until you delete the cookie. Details about the data processing by the CMT can be found in the user interface of the tool.

Part 2

Cookies

This website uses cookies to provide you with the best possible user experience. A cookie is a small text file that a website stores on your computer or mobile device when you visit the site. These text files contain certain information. With regard to cookies, a distinction is made between so-called session cookies and persistent cookies. While session cookies are automatically deleted after the end of the respective session (closing your browser), persistent cookies can be stored over several sessions.

Cookies are used to analyze user data (to keep the user logged in), to store preferences, to provide services, to track users of the website, to monitor and analyze performance, features and effectiveness, to track marketing campaigns, for security reasons and to protect against fraud, and to detect and prevent cyber-attacks.
